These Terms & Conditions ('Ts&Cs') apply to the provision of goods on www.helmsmanship.co.uk (the 'website').
Please read these T&CS carefully before purchasing.
Definitions:
- 'we' and 'us' means Go Lead Ltd ('Go Lead') who will provide the goods to you.
- 'you' means the person receiving the goods;
- 'goods' means the provision of online courses and other learning materials via the Website, and any ancillary support such as coaching, mentoring, seminar, etc.
Username and Password
When you purchase from Go Lead, we ask you to create a username and password. Please keep your username and password confidential, and notify us immediately of any unauthorised use.
We reserve the right to ask you to alter your username and password if we believe that they are no longer secure.
Privacy Policy
Please read our Privacy Policy for further details about the information we collect and how it is used. You acknowledge and agree that you have understood and accept the terms of the Privacy Policy by using this Website.
Provision of Online Courses
We will provide you with access to the course(s) after purchase. The courses are only available online at our website www.helmsmanship.co.uk and you will need an active internet connection, preferably broadband.
The courses are not provided in an offline format nor can they be downloaded to your computer.
You can log into the website with your user name and password from any computer, but be sure to check that the computer has the required software to run the course. This will usually, but not always, be a Flash player.
Provision of Services
Ancillary support will be provided according to the terms of the individual service purchased.
Technical Support
If your computer does not have the necessary players or the latest version of the players installed, you should be able download the player or an update from a publicly accessible site or the software owner. If this does not work, please contact us, using the details below. We can provide limited technical support during normal office hours and will do our best to assist. However, we cannot guarantee technical support will always be available.
From time to time, we may experience periods of downtime and may be unable to provide technical support. You accept that you will not have a claim for breach of contract against us owing to unavailability of support.
We exclude all other warranties, express or implied, as to the performance and availability of the technical support service, except as expressly stated in these Ts&Cs. We do not guarantee that the technical advice we provide will resolve your technical problems and if you decide to follow our advice, you should ensure it is strictly followed.
Availability of Our Website
We will use reasonable endeavours to ensure that the website is available 24 hours a day 7 days a week. However, we may have to suspend access to the website for emergency maintenance or repairs. Your access may also be interrupted due to failures of telecommunications, internet providers and equipment which are beyond our control.
Warranty
We do not guarantee that our courses and services will deliver any particular result or that you will obtain obtain any particular qualification on completion.
We do not make any commitment that the course(s) will be compatible with or operate with the software or hardware on your computer.
If you do enable cookies or download publicly accessible software to ensure that your computer is capable of running the courses, you do so at your own risk and third party cost.
All representations, warranties and/or terms and/or commitments not expressly set out in these T&CS (whether implied by law, conduct, statute or otherwise) are hereby excluded to the maximum extent permissible at law.
Pricing
Prices displayed on the site, in catalogues, price lists or other sales literature are correct at the time of display. We reserve the right to alter prices from time to time without notice. However, once we have accepted your order, we will not change the price that applies to such order.
We make every effort to maintain prices but prices may occasionally move up or down depending upon changes in cost of goods or other processing costs.
All prices displayed are inclusive of United Kingdom VAT at the prevailing standard rate. UK VAT is charged on all sales to customers located within the UK or within another Member State of the European Community (EC).
If you are purchasing from outside the UK or another Member State of the EC, VAT will be deducted from the price of the goods.
Payment information
We accept payment by PayPal or any other credit card identified on our site that may be accepted by us from time to time.
We take payment from your card at the time we take your order.
All credit and charge card payments are subject to validation and authorisation by the card issuer. If your card issuer refuses to authorise payment, we will not be liable for any non-delivery or delay.
You may pay for your goods by sterling cheque drawn on a UK clearing bank. However, we will not provide access to the courses or services until the cheque has cleared. After validation or receipt of your cheque, we will confirm your order by email to the email address you provided on the purchase order. Our acceptance of your order constitutes a legally binding agreement between us.
Transmission of your debit or credit card number or other data in relation to payment for the goods shall be at your entire risk. We cannot accept any responsibility or liability for failures in transmission of information, deletion, non-delivery or failure to store any communications by you.
Cessation of Online Course(s) Provision
We will make the online courses available to you via the Website from the date of purchase until either:
- the period of availability advised at the time of purchase has expired; or

you have notified us that you no longer need access to the website.
We reserve the right to stop providing the Services to you immediately in the event that you fail to comply with the paragraph below regarding usage rights.
Your Rights to Use the Online Courses
When you purchase a course(s), we grant to you a non-exclusive, non-transferable license (i.e.not to be used by, or transferred to, another person) for you to use the course(s) for the sole purpose of non-commercial home or work use. You may print for your personal use any materials provided in the course or on the website as are reasonable for private purposes.
Other than set out in these T&CS, you may not modify, copy, reproduce, re-publish, upload, post, transmit or distribute in any way any of the goods. Any use not expressly permitted in these Ts&Cs is strictly prohibited and will constitute an infringement of either our copyright or our other intellectual property rights, and / or the copyright or other intellectual property rights of our licensors.
Liability
Goods purchased from our website are subject to English Law.
Nothing in these Ts&Cs is to be taken to exclude or restrict any rights which applicable law grants to you in respect of such goods.
We do not accept any responsibility and will not be liable for any damage to the goods caused by you.
We shall not be responsible to you for any data that you lose either (a) as a result of accessing the online courses; or (b) during completion of any course via the Website. It is your responsibility to ensure that you regularly save and back up (i) all data which you hold on the computer from which you are accessing the courses, and (ii) all data that you are inputting when completing the course.
We shall not be liable to any person for any damage or loss that may arise from the use of any goods advertised on our website.
All the information and materials contained in this website (including, without limitation, text, graphics and links) are provided on an "as is" basis with no warranty and in particular, we do not represent or warrant that the information accessible via this website is accurate, complete or current or that the use of this website will be uninterrupted or error-free.
Notwithstanding anything else in these Ts&Cs, in relation to any one event or series of events relating to the purchase of any goods from our website, we will not be liable for: (i) claims relating to the availability of our online store, our e-commerce engine, other Go Lead websites, points of purchase, or the success or level of sales resulting therefrom; (ii) any indirect, incidental or consequential damages, loss of earnings, anticipated savngs, goodwill, revenue or profits.
We shall not be responsible to you in the event that we cannot provide the goods to you due to an event beyond our reasonable control, which includes (but is not limited to) events such as, fire, flood, storm, strikes or other industrial action, failure of telecommunications services, war, riot, or the actions of any government or public body. In the event that we are prevented from providing the goods by such an event, we will take all reasonable steps to try to reinstate the provision of the goods to you as soon as is reasonably practicable.
The above exclusions of liability shall not apply to any damages arising from personal injury or death where they result from our negligence or the negligence of our servants and agents in the course of their duty.
Except where the above applies, our maximum aggregate liability to you for any claim that you may have against us shall be limited to the amount of the fee which has been paid or is payable by you or on your behalf.
General
Notices served under these Ts&Cs shall be in writing and will be deemed given when: (1) personally delivered; or (2) when sent by confirmed fax; or (3) three days after being sent by registered mail to the address set out in our despatch note, or to any other later address in the United Kingdom notified for that purpose.
Any failure by us to enforce any of these Ts&Cs shall not affect our right to enforce the rest of these Ts&Cs.
These Ts&Cs are subject to change at any time without prior notice to you.
These Ts&Cs shall be governed by and construed in accordance with English Law.
The agreement between us which is comprised of these Ts&Cs is not intended to be for the benefit of any third party, and shall not be exercisable by any other person under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
The continued use of the Website following any changes to the Ts&Cs will mean that you accept such changes.
